Terms of service

The agreement, in plain language.

These terms govern your use of Wellington. They are written to be read. Where a sentence has legal weight, we have tried to make it carry that weight without dressing it up.

1. The parties, and who may use Wellington

Wellington (the “Service”) is provided by Therabot Labs LLC (“we”). By using the Service you agree to these terms. If you do not agree, do not use it. You must be at least 18 years old to create an account or take an assessment. We do not knowingly offer the Service to anyone younger, and we do not knowingly collect data from anyone younger; see the age provisions in the privacy policy.

2. What Wellington is, and is not

Wellington is a self-report personality assessment with a written report, offered as a wellness tool for reflection. It is not a medical device, a psychological or psychiatric assessment, a diagnosis, therapy, or professional advice of any kind, and using it does not create a doctor-patient, therapist-client or any other clinical relationship between you and us. It does not screen for or detect any condition. The report describes ordinary variation in personality and habits. You should not use it, and must not use it in respect of others, to make decisions about employment, education, housing, credit, insurance, medical treatment or legal matters.

If you are concerned about your mental health, consult a qualified professional. If you are in crisis or thinking about suicide, this Service is not equipped to help; in the United States you can call or text 988 to reach the 988 Suicide & Crisis Lifeline, any time, free and confidential. If you are outside the United States, contact your local emergency number or crisis line. The science page and the assessment itself repeat this notice; a crisis is never a reason to keep answering questions.

3. Your account and signing in

An account is created when you give us your email address. Wellington is passwordless: sign-in is by a one-time “magic link” emailed to that address, which expires after a short time and can only be used once. Keep access to your inbox secure, because anyone who controls it controls the account. You are responsible for the accuracy of the details you give us. One person per account. Do not use the Service on behalf of, or to assess, another person without their knowledge and consent.

4. The tiers, and what you get

  • Free Snapshot (free): a 60-item assessment giving you your personality card and five dimensions, in exchange for a verified email address.
  • Portrait Report ($0.99, one payment): your eight written chapters, one for each dimension. Access does not expire.
  • Wellington Membership ($4.99 a month, charged monthly, renewing): the 336-item Portrait and the full interactive report, every Big Five facet and all 24 VIA character strengths, a downloadable PDF, plus 52 weekly modules, weekly insight emails, trend lines and an annual re-take, for as long as the subscription is active. It includes everything in the Portrait Report.

Prices are in US dollars and include any applicable tax unless stated otherwise at checkout. We may change prices; changes to the Wellington Membership price take effect at your next renewal and we will email you at least 30 days before.

5. Payment, automatic renewal and cancellation

Checkout and the billing portal are hosted by Stripe; you pay Stripe directly and we never see your card number. Before you pay for the Wellington Membership, the checkout page states the price ($4.99 a month), that there is no free trial, that it renews automatically every month, and how to cancel, and you give affirmative consent to those terms by ticking the box and completing payment. That disclosure and your consent are what the law calls “clear and conspicuous” automatic-renewal terms and affirmative consent to them, required by the U.S. Restore Online Shoppers’ Confidence Act and by state automatic-renewal laws including California’s.

You can cancel at any time, with no need to call or speak to anyone, from your dashboard or from the link in any membership email; cancellation stops future renewals immediately and your access continues to the end of the month you have already paid for, with no partial-period charge. The membership is also covered by a 30-day money-back guarantee: if it is not right for you, contact support within 30 days of a charge for a full refund. If a renewal payment fails, we will retry it and email you; if it continues to fail, the subscription ends and your membership features pause.

6. Purchases and refunds

Our policy is set out in full on the refunds page and forms part of these terms. In summary: purchases are final, and every tier begins with the free Snapshot so that you can see the quality before you pay for the writing. If something about a purchase is not right, contact us and we will consider it in good faith. Statutory rights that cannot be excluded are unaffected.

7. Your content and our content

Your answers are yours. You grant us a licence to store and process them to provide the Service, and to use them in de-identified, aggregate form to estimate norms, as described in the privacy policy. The assessment items are drawn from public-domain sources, or modelled on them, and remain in the public domain. The report text, trait pages, archetype names, design and software are ours or our licensors’ and are protected by copyright. You may download, print and share your own report for personal use. You may not copy the trait pages, scrape the Service, resell access, or use the report text to build a competing product.

8. Acceptable use

Do not attempt to access another person’s account or data, interfere with the Service, submit automated responses, or use the Service for anything unlawful. We may suspend or close accounts that do.

9. Indemnity

You agree to indemnify and hold Therabot Labs LLC harmless from any claim, loss or expense, including reasonable legal fees, arising from your breach of these terms, your misuse of the Service, or your violation of any law or of another person’s rights, including where you have used the Service to assess someone without their knowledge and consent as described in section 3.

10. Accuracy and changes to the Service

We describe how the assessment works on the Science page. Scores are estimates, and bands may shift as we refine our reference; when that happens we will tell you. We may change, add or remove features of the Service. If a change materially reduces what a paid tier provides during a period you have paid for, you may cancel and receive a pro-rated refund of that period.

11. Disclaimer and limitation of liability

The Service is provided as described, without warranties beyond those we cannot lawfully exclude. To the fullest extent permitted by law, we are not liable for indirect or consequential loss, and our total liability to you in connection with the Service is limited to the amount you paid us in the twelve months before the claim. Nothing in these terms excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be excluded by law. Nothing here limits your statutory consumer rights.

12. Ending the agreement

You may close your account at any time using Delete my data, which deletes your data immediately. We may close your account for breach of these terms; if we do so for any other reason, we will refund any unused portion of a paid period.

13. Governing law and dispute resolution

These terms are governed by the law of the State of Delaware, United States, without affecting any mandatory consumer protections of the country in which you live. If you are in the United States, they are additionally governed by the law of the State of Delaware, without regard to its conflict-of-laws rules. If we have a dispute, write to us first at [email protected]; most things can be resolved in a couple of emails.

Otherwise the courts of the State of Delaware, United States (or, for U.S. residents, of Delaware) have jurisdiction, subject to any right you have to bring proceedings where you live.

14. Changes to these terms

We may update these terms. If a change matters, we will email account holders at least 14 days before it takes effect. Continued use after that date is acceptance of the new terms.
